Why does my dog go upstairs in my kids room and use the bathroom up there?

he will just go outside be out for like 10 minutes then come in go up in there room and use teh bathroom pee and shit.

1. No idea, but until you absolutely get rid of the pee smell and NEUTRALIZE, not just deodorize, the places the piddles, he will keep doing it. Get a pet urine neutralizer at the grocery or pet shop and thoroughly clean the area - then close the door to the kids rooms, end problem.
2. This is "pack" behavior. Dogs that accept other dogs into their social network will pee in the same place after another dog does it. Could be your dog is doing something like that - he considers the kids to be members of his pack.
3. He considers that he would like his placement in your pack above the children. Very common. Work with him in obedience class and have the children train him as well, so that they establish their dominance above him. When he comes in leash him and close the door to their room so that he can't mark it as his territory. Keep him with you to do sits and downs. He has too much house freedom and hasn't earned it.
